1. Agreement to Terms
By visiting or using the Dead Podcasters Society website (the “Site”), you agree to these Terms and Conditions and to follow all applicable laws and university policies. If you do not agree, please do not use the Site or any of its features.
2. Who We Are
Dead Podcasters Society (“DPS”) is a creative, student‑driven podcasting society with college chapters across the United States, focused on storytelling, “fun journalism,” and audio experimentation in a safe, inclusive environment. The Site exists to showcase member work, share resources, and connect current and future chapters.
3. Use of the Site
You may use the Site to:

Learn about DPS, its chapters, events, and initiatives.

Stream or download publicly available DPS podcasts and related content.

Contact DPS leadership or submit interest in starting or joining a chapter.
You agree not to use the Site in any way that could harm DPS, its members, its reputation, or interfere with others’ ability to access or enjoy the Site.
4. Intellectual Property
Unless otherwise noted, all content on the Site—including text, logos, graphics, artwork, audio files, and episode descriptions—is owned by DPS, its chapters, or individual creators and is protected by copyright and other intellectual property laws.
You may:

Stream or download podcasts for personal, non‑commercial listening.

Share links to episodes or pages on social media, in classes, or with friends.
You may not:

Reproduce, redistribute, remix, or sell DPS content without prior written permission from the relevant creators and/or DPS leadership.
5. User Submissions and Member Content
Some parts of the Site may allow you to submit information (for example, contact forms, chapter interest forms, or show pitches). By submitting content, you:

Confirm that the information you provide is accurate and that you have the right to share it.

Grant DPS a non‑exclusive, worldwide, royalty‑free license to use that information to operate the Site, respond to your inquiry, and, where applicable, feature your show or chapter.
Student‑produced podcasts remain the intellectual property of their creators subject to any agreements in place with their university, station, or program.
6. Community Standards
Dead Podcasters Society values creativity, inclusivity, and ethical storytelling. By using the Site, you agree that you will not:

Post, submit, or promote content that is harassing, hateful, defamatory, obscene, or otherwise violates university or institutional codes of conduct.

Impersonate DPS leadership, chapter officers, or any other person or entity.

Use the Site to organize or promote hazing or any unsafe activities, which are strictly prohibited in all DPS chapters.
7. Third‑Party Links and Platforms
The Site may link to third‑party platforms (for example, podcast hosting services, social media accounts, event registration tools, or university pages). DPS does not control and is not responsible for the content, policies, or practices of these third‑party sites. Accessing them is at your own risk and subject to their own terms and policies.
8. No Professional or Academic Advice
Content on the Site—including blog posts, resources, and podcast episodes—is for general informational and educational purposes only. It does not constitute legal, academic, mental health, or professional advice. Always consult appropriate professionals or your institution when making decisions that could affect your academic or professional status.
9. Disclaimer of Warranties
The Site and all content on it are provided on an “AS IS” and “AS AVAILABLE” basis. DPS does not guarantee that the Site will be uninterrupted, error‑free, secure, or free from viruses or other harmful components, nor does it guarantee that any content is complete or up‑to‑date. Your use of the Site is at your own risk.
10. Limitation of Liability
To the fullest extent permitted by law, DPS, its advisors, officers, student leaders, and chapter representatives will not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the Site or any content on it, even if advised of the possibility of such damages. Where liability cannot be excluded, it will be limited to the amount you paid (if any) to use the Site in the six (6) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless DPS, its leadership, advisors, and chapters from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of another person or entity.
12. Changes to the Site and These Terms
DPS may update or change the Site, its features, or these Terms from time to time. The “Last updated” date at the top of this page indicates when these Terms were last revised. Your continued use of the Site after changes are posted means you accept the revised Terms.
13. Governing Law
These Terms are governed by the laws of the state in which the DPS host institution is located (unless your local laws require otherwise), without regard to conflict of law principles. You agree that any dispute arising out of or relating to the Site or these Terms will be brought in the courts located in that state, where jurisdiction is appropriate.
14. Termination of Access
DPS may suspend or terminate your access to the Site, in whole or in part, at any time and for any reason, including if DPS believes you have violated these Terms or engaged in conduct that could harm the DPS community. Sections that are meant to survive termination (such as intellectual property, disclaimers, and limitations of liability) will continue to apply.
15. Severability
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
16. Entire Agreement
These Terms constitute the entire agreement between you and DPS regarding your use of the Site and supersede any prior or contemporaneous agreements or understandings related to the Site.
